1. Agreement to Terms

These Terms and Conditions (“Terms”) govern your use of the LMP Platform web application, the Loch Monster Plumbing (LMP) mobile app, and related communications provided by Loch Monster (“we”, “our”, or “us”). By accessing or using our services, providing a phone number for business communication, or receiving SMS from us, you agree to these Terms and our Privacy Policy.

2. Description of Services

We provide a business operations platform for managing jobs/binders, scheduling, forms, contacts, addresses, reports, and related communications. Our services include:

• Web and mobile tools for authorized company users
• Outbound SMS to customers and contacts about service work, scheduling, and related follow-ups
• Inbound SMS from customers and contacts to our business numbers
• Internal OTP SMS for authentication or verification of authorized internal users

3. SMS / Text Messaging Terms

By providing a mobile phone number for business communication related to plumbing or service work (for example during phone intake, on-site service, or on a service agreement/work order), and agreeing to receive texts, you consent to receive transactional SMS messages from Loch Monster.

• Messages may include job updates, appointment or scheduling notices, requests for information needed to complete work, and responses from company staff.
• Authorized internal users may also receive OTP (one-time passcode) texts for login or verification.
• Message frequency varies based on active jobs, customer needs, and authentication events.
• Message and data rates may apply.
• Reply STOP to opt out of customer service SMS. Reply HELP for help.
• We do not sell or share mobile numbers with third parties or affiliates for marketing or promotional purposes.

Consent to receive SMS is not a condition of purchasing goods or services where applicable law prohibits that practice. Carriers are not liable for delayed or undelivered messages.

SMS Opt-In / Call to Action (CTA)

Customers and contacts opt in to Loch Monster Plumbing SMS by providing a mobile phone number for business communication and agreeing to receive transactional texts about their plumbing/service work. Opt-in occurs by one of these methods:

• Verbal: During phone intake or on-site service, staff collect the customer’s mobile number and obtain consent using language substantially as follows:

“By providing your mobile number, you agree to receive text messages from Loch Monster Plumbing about your service job, scheduling, and related follow-ups. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help. Consent is not required as a condition of purchase. Privacy Policy: https://app.lochmonsterplumbing.com/privacy-policy. Terms: https://app.lochmonsterplumbing.com/terms-and-conditions.”

• Paper form: On a service agreement/work order, the customer provides a mobile number and signs or acknowledges the same SMS disclosure.

After opt-in, authorized staff may send outbound service-related SMS, and customers may reply inbound. This campaign does not use marketing or promotional mass messaging. A standalone copy of this Call to Action is also published at /sms-consent.

4. Accounts and Acceptable Use

Platform accounts are for authorized users of Loch Monster and its organizations. You agree to keep login credentials confidential, use the platform only for lawful business purposes, and not misuse SMS or other communication features (including spam, harassment, or unauthorized marketing).

5. Privacy

Our collection and use of personal information, including phone numbers and SMS content/logs, is described in our Privacy Policy. Please review that policy carefully.

6. Intellectual Property

The platform, branding, and related materials are owned by Loch Monster or its licensors. You may not copy, modify, or distribute our software or content except as allowed by these Terms or with our written permission.

7. Disclaimers

The platform and SMS services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free service, including SMS delivery.

8. Limitation of Liability

To the fullest extent permitted by law, Loch Monster and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the platform or SMS services.

9. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
